In March 2026, a federal district court sided with Amazon in a case against Perplexity AI, ruling that Perplexity's "Comet" browser violated the Computer Fraud and Abuse Act (CFAA). Comet had been accessing Amazon accounts with users' permission — but without Amazon's authorization.

The Problem: Trying to Fake the Process

Amazon's core grievance wasn't just data access — it was bypass. Agentic AI skipped past recommendation algorithms and sponsored placements, going straight to "Buy Now." In education, the analog is more consequential: the writing process is the learning.

Today, agents that attempt to simulate human writing behavior are not very good at it. They burn through API tokens at impractical rates. They're brittle. The behavioral patterns they produce are conspicuously artificial — rhythm off, pauses in the wrong places, revision patterns that don't track how anyone actually thinks through an argument. Current process-capture tools can spot them without much difficulty.

However, this wont last. We've seen this trajectory before. Two years ago, AI-generated text was easy to identify — awkward phrasing, generic structure, a distinctive "AI voice." Today, the best models produce prose functionally indistinguishable from human writing. AI text detectors that once seemed reliable have been forced to acknowledge fundamental accuracy limitations. Detecting AI through output alone became a losing game.

Behavioral simulation is on the same path. Compute costs are dropping. Models are improving. It's not a question of whether agents will produce keystroke records indistinguishable from a real student working through a draft — it's a question of when. That's why the legal layer matters as much as the technical one.

Authorized vs. Covert: The Line Platforms Can Now Draw

This isn't an argument against AI in education. Students should use AI — to brainstorm, to get feedback, to pressure-test their thinking. The difference is whether the AI declares itself or disguises itself.

An AI brainstorming tool that logs its contributions and makes them visible to the instructor is a participant in the learning process. An agent that simulates keystrokes and impersonates human behavior to avoid detection is undermining it — not because it can't identify itself, but because doing so would defeat the purpose. Today these agents are clumsy enough to catch. Tomorrow they may not be.

That's the line this ruling lets platforms draw. Following the decision, Amazon updated its terms to require AI agents to identify themselves. We've done the same — Rumi's Terms of Service now explicitly prohibit unauthorized agents and require any AI tool accessing the platform to declare itself. On the technical side, we already use services like Cloudflare to detect and block bot traffic before it reaches the platform. But no technical barrier is permanent — if an agent is sophisticated enough to bypass detection, the legal framework now gives platforms like ours grounds to act anyway. The CFAA precedent means that platforms which prohibit undeclared agents have civil legal standing to enforce it, regardless of how sophisticated the spoofing becomes.

What This Means for Process-Focused Platforms

The value of process visibility has never been primarily about catching dishonesty. It's about making learning legible — to instructors, to institutions, and to students themselves.

But the honest reality is that detection alone was never going to be a permanent answer. Just as AI-written text outpaced AI text detectors, AI-simulated behavior will eventually outpace behavioral anomaly detection. The platforms that prepare for that future are the ones building on two layers: technical depth that keeps raising the bar on what agents need to simulate, and legal standing that doesn't require detection to succeed.

The question is no longer just "were there keystrokes?" It's "do those keystrokes tell the story of a mind at work?" That's the standard process-focused platforms need to build toward — and it's the standard the Amazon-Perplexity ruling gives them legal footing to protect.
